These Terms constitute a legally binding agreement between you (“you” or “user”) and Turtle AI (“Turtle AI,” “we,” “us,” or “our”). By using the Services, you represent that you are at least 18 years old and have the legal capacity to enter into this agreement.

Turtle AI provides a platform for users to create scientific visualizations and diagrams using AI. The Services include:

• AI-powered diagram generation
• Access to a library of visualization templates
• Account management
• Customer support

We offer both free and paid (Pro) plans with varying features and usage limits.

To access certain features of the Services, you may be required to register for an account. You agree to:

• Maintain the security of your password and accept responsibility for all activities that occur under your account
• Notify us immediately of any unauthorized access or use of your account

You agree to use the Services only for lawful purposes and in compliance with these Terms and our Usage Policy. You agree not to:

• Use the Services in any way that violates any applicable law or regulation
• Upload or transmit any content that is illegal, harmful, offensive, or infringing
• Attempt to gain unauthorized access to the Services or any related systems or networks
• Interfere with or disrupt the Services or the experience of other users
• Use the services in any way that violates another person’s privacy
• Use the service to create visualization with the intent to spread malicious information

If you choose to subscribe to the Pro Plan, you agree to pay the applicable fees. All fees are non-refundable, except as expressly stated in these Terms or as required by applicable law. We may change our fees at any time, but we will provide you with reasonable notice of any changes.

Your Pro Plan subscription will automatically renew on a recurring basis unless you cancel it before the renewal date. You can cancel your subscription through your account settings.

We may terminate your access to the Services at any time, with or without cause, and with or without notice. You may terminate your account at any time through your account settings.

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTY OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO THE IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the services will be uninterrupted, error-free, or secure.

IN NO EVENT SHALL TURTLE AI BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATING TO YOUR USE OF THE SERVICES, WHETHER BASED ON CONTRACT, TORT, STRICT LIABILITY, OR ANY OTHER THEORY, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY TO YOU FOR ANY CLAIM ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICES SHALL NOT EXCEED THE AMOUNT YOU PAID TO US, IF ANY, FOR ACCESS TO THE SERVICES.

You agree to indemnify, defend, and hold harmless Turtle AI and its affiliates, officers, directors, employees, and agents from and against any and all claims, liabilities, damages, losses, costs, expenses, or fees (including reasonable attorneys’ fees) arising out of or relating to your use of the Services or your breach of these Terms.

We may update these Terms from time to time. We will notify you of any material changes by posting a notice on our website and sending you an email. Your continued use of the Services after any changes to these Terms constitutes your acceptance of the revised Terms.

These Terms constitute the entire agreement between you and Turtle AI relating to your use of the Services and supersede all prior or contemporaneous communications and proposals, whether oral or written, between you and us.
